Prenuptial and Postnuptial Agreements
Prenuptial and postnuptial agreements provide clarity and certainty about the treatment of some or all assets belonging to married individuals. Depending on a client’s needs, we will either draft a prenuptial and postnuptial agreement, or, alternatively, review an agreement drafted by their current or future spouse’s attorney. We draft prenuptial and postnuptial agreements based upon each client’s goals and unique circumstances. And we explain draft agreements by discussing their implications in specific, likely future scenarios for our client.
Prenuptial and Postnuptial Agreement Process
Introductory Call
We will have a brief conversation to introduce ourselves and discuss your needs. If you decide to proceed with a prenuptial or postnuptial agreement, we will ask you to complete a questionnaire with some basic information about yourself and your assets.
Initial Meeting
We will have an approximately one-hour meeting. If we are drafting an agreement for you, we will discuss what your prenuptial or postnuptial agreement will say, based upon your wishes and goals. If, instead, we are reviewing an agreement already drafted by your current or future spouse’s attorney, we will discuss what the draft agreement says and its implications for you. This meeting can be virtual or in person at our office.
Draft and Negotiate
If we are drafting a prenuptial or postnuptial agreement, we will send you a draft agreement, along with a summary highlighting the important provisions. If your current or future spouse’s attorney already drafted an agreement, we will reach out to the attorney with any questions or proposed revisions, based upon our discussion during our initial meeting.
Sign
Once you are comfortable with your prenuptial or postnuptial agreement and any negotiations are complete, you and your spouse will sign the agreement. The signing logistics will largely depend upon how quickly the signing must take place and what is convenient for you. You can sign at our office, or you can print the final agreement and sign on your own.
